Information automatically collected
In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.
We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information.
4. How Do We Process Your Information?
In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.
5. When and With Whom Do We Share Your Personal Information?
In Short: We may share information in specific situations described in this section and/or with the following third parties. Mobile information (phone numbers and SMS opt-in data) is never shared with third parties or affiliates for marketing or promotional purposes.
SMS / Text Messaging — Mobile Phone Numbers and SMS Opt-In Data. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
We send transactional SMS such as booking confirmations, session reminders, payment updates, and account or safety alerts. Message frequency varies based on your activity (approximately 2–8 messages per month). Message and data rates may apply. Reply HELP for help or STOP to opt out at any time.
All SMS opt-in data, including phone numbers and consent records, is not sold, rented, or shared with any third party. SMS opt-in consent and the associated phone numbers are not shared with any third party for any purpose, except for our SMS messaging service provider (Twilio) solely to deliver the messages you have requested. This restriction also applies to any subprocessors who help us operate our SMS program. Information sharing to subcontractors in support of our services, such as customer service, is permitted, but those parties are not permitted to use your mobile information for their own marketing purposes.
SMS opt-in is entirely optional and is never a condition of registering for, purchasing, or using any Nooqbook product or service. Users may withdraw consent at any time by replying STOP, or by disabling SMS notifications in their account settings.
We may need to share your personal information (other than the SMS opt-in data described above) in the following situations:
- Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
- Affiliates. We may share your information (excluding mobile information and SMS opt-in data) with our affiliates, in which case we will require those affiliates to honor this privacy notice. Affiliates include our parent company and any subsidiaries, joint venture partners, or other companies that we control or that are under common control with us.
- Business Partners. We may share your information (excluding mobile information and SMS opt-in data) with our business partners to offer you certain products, services, or promotions.
- Service Providers. We share information with companies that help us run the Services, only as needed for them to do that work: Stripe (payments and instructor payouts), First Advantage (instructor background checks), Amazon Web Services (hosting and file storage), Mailgun (email), Twilio (text messages), Expo/Apple/Google (push notifications), Zoom (virtual lessons), and Notion and Slack (support and feedback tracking). They may not use your information for their own marketing.
6. Do We Use Cookies and Other Tracking Technologies?
In Short: We may use cookies and other tracking technologies to collect and store your information.
We may use cookies and similar tracking technologies (like web beacons and pixels) to access or store information. Specific information about how we use such technologies and how you can refuse certain cookies is set out in our Cookie Notice.
7. Is Your Information Transferred Internationally?
In Short: We may transfer, store, and process your information in countries other than your own.
Our servers are located in The United States of America. If you are accessing our Services from outside, please be aware that your information may be transferred to, stored, and processed by us in our facilities and by those third parties with whom we may share your personal information, in and other countries.
If you are a resident in the European Economic Area (EEA), United Kingdom (UK), or Switzerland, then these countries may not necessarily have data protection laws or other similar laws as comprehensive as those in your country. However, we will take all necessary measures to protect your personal information in accordance with this privacy notice and applicable law.
8. How Long Do We Keep Your Information?
In Short: We keep your information while your account is open. When you delete your account, we delete or anonymize your personal information, except for the records described below, which we keep without your contact details.
While your account is open, we keep your information for as long as you use the Services.
When you delete your account, we delete your profile, contact information, password, photos and uploaded files (photos you uploaded for a city's programs belong to that city and stay with it), listings, availability, saved items, preferences, device and notification registrations, and identification images. We remove your children's names and sensitive details, keeping only their birth year, so that their program and consent records no longer identify them.
We keep the following records indefinitely, because they are needed for accounting, tax, legal claims, dispute resolution, and the safety of the families who use Nooqbook. They are no longer linked to your email address or phone number, and your name is removed except where it is part of the record itself, such as the name entered when accepting a waiver, or what you wrote in a feedback report. So that we can find these records if you or a regulator asks about them, we keep a coded version of your email address that cannot be turned back into the address, and we delete that code about 7 years after your deletion:
- Payments, refunds, payouts, account credits, and invoices
- Bookings and program registrations (dates, programs, and amounts)
- Disputes, including the evidence submitted
- Waiver acceptances (the name entered, the date, and the waiver text)
- Parental consent records (the version, method, and date of consent)
- Background-check outcomes (status, result, and date)
- Safety reports, content flags, and security and audit logs
- Feedback and support reports you sent, including any screenshots
- Signed partnership agreements
Messages you sent remain visible to the people you sent them to, shown as from "Deleted user." Announcements you sent on behalf of a city remain with that city.
Information about a city organization, such as its address, programs, and tax details, belongs to that city and is not deleted when an individual staff member deletes their account.
Deleted information is removed from our backups as those backups expire, within 90 days.
Some of our service providers keep records under their own legal obligations and privacy policies. These include Stripe (payment and payout records, and instructors' Stripe accounts) and First Advantage (background-check information).
9. Do We Collect Information from Minors?
In Short: Only adults can create accounts. Parents and guardians may give us information about their children so the children can take part in lessons and programs.
You must be 18 or older to create an account. We do not knowingly collect information directly from children. A parent or guardian may add a child to their account and give us the child's name, birth date, and, if they choose, health, allergy, special-needs, custody, and emergency-contact details. We use this information only to provide the lessons and programs the parent selects and to keep the child safe. We share it only with the instructors and city programs the parent registers the child with, and with any other parent or guardian the parent chooses to share the child with.
A parent can edit or remove a child's information at any time in the app or on the website, and it is deleted when the parent deletes their account (see "How long do we keep your information?"). If you believe a child has created an account or given us information directly, contact support@nooqbook.com and we will delete it.
10. What Are Your Privacy Rights?
In Short: You may review, change, or terminate your account at any time.
Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided below.
However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.
Account Information. You can review and change your account information at any time in the Nooqbook app or on the website. You can delete your account at any time. See "How can you delete your account?" below.
11. Controls for Do-Not-Track Features
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.
12. Do We Make Updates to This Notice?
In Short: Yes, we will update this notice as necessary to stay compliant with relevant laws.
We may update this privacy notice from time to time. The updated version will be indicated by an updated "Revised" date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification.
13. How Can You Contact Us About This Notice?
If you have questions or comments about this notice, you may email us at:
Email: support@nooqbook.com
14. How Can You Review, Update, or Delete the Data We Collect from You?
You can review and update most of your information in your account in the Nooqbook app or at app.nooqbook.com. To request a copy of your information, or to ask about information you can't change yourself, email support@nooqbook.com.
15. How Can You Delete Your Account?
In the app: Sign in and go to Account → Delete account.
On the web: Sign in and go to app.nooqbook.com/account/delete.
Before you confirm, we show you what deleting your account will affect, and we ask for your password. If you don't know your password, use "Forgot password" to reset it first. You can also email support@nooqbook.com and we will help you.
When you confirm:
- You are signed out on every device right away, and your account can no longer be used.
- Upcoming bookings and program registrations are cancelled under our normal cancellation policy, including any refunds that policy provides. If you are an instructor, your upcoming lessons are cancelled and your students are refunded in full.
- Any account credit you have is forfeited.
- If you are the owner of a city account, ownership passes to another owner or administrator of that city. If there is no other owner or administrator, the city account remains and Nooqbook will help the city appoint a new owner.
- We email you to confirm we received your request.
Deletion is usually completed within 24 hours and always within 30 days of your request. If you are an instructor, earnings that are still owed to you continue to be paid to your Stripe account. We show you the completion date before you confirm, and we email you when deletion is complete.
Deleting your account cannot be undone. You can create a new account later with the same email address, but your previous information will not be restored. See "How long do we keep your information?" for the records we keep.
